Legal Implications on Token Issuing (ICO)

Based on FINMA’s three token categories (Payment Token, Utility Token and Asset Token), the attached overview shows the legal implications on a token issuing, Initial Coin Offering (ICO) or Initial Token Offering. The overview is „work-in-progress“ and it goes without saying that such an overview can never be complete and each token must be analysed in detail before it is issued. The principle of „substance over form“ applies.
